Nationwide Guaranteed Delivery

All mail order gifts are packaged in strong, approved outers and sent via carriers with full insurance. All gifts are controlled by a computerized tracking system and have to be signed for at the recipient's address. Please make sure all addresses are accurate and include the postal town and postal code, together with the recipient's telephone number. This enables us, and the carriers, to speedily and accurately deliver your gifts. Inaccurate addresses may incur extra delivery charges to yourself, and an inevitable delay. Our guarantee is limited to delivering to the building, not individual recipients.

Claims for loss or damage

Delivery services have significantly improved in recent years, so in the unlikely event of damage or loss in transit, we will replace the damaged contents or gift immediately free of charge providing the following:

  1. The goods are signed for upon receipt as either 'damaged' or 'unexamined'
  2. The carrier and ourselves are informed at once and it is confirmed by the recipient to us in writing within three days of delivery quoting reference number on the parcel.
  3. Damaged goods must be retained for inspection and it may be required that they be returned to us at our expense before replacement or refund.
  4. We regret that claims cannot be accepted if over fourteen days from date of despatch.

Returned goods must clearly show the full name and address of the sender. Our liability is limited to the selling price of the goods in all cases.

We cannot be held responsible for late or non-delivery due to adverse weather conditions. We cannot accept responsibility for the wrong order or non-delivery, resulting from incorrect information or addresses being provided.

Data Protection

We have obligations in relation to your personal information under the Data Protection Act 1998. Some of the information you provide may be "sensitive" information under the Act (i.e. information on "delicate" matters, including race, political opinions, religion, trade union membership, physical or mental health or condition, sexual life etc). By registering for the Service and providing your details, you agree to us using information in the way set out above. Where you provide information about other people (for example their address) you also confirm that have the consent of these people to provide us with that information.

Security

Your browser will go into secure mode as soon as you access the 'checkout' or 'login' pages, i.e. before you enter any personal or payment details. You can check that you are shopping in a secure environment by looking for either a locked padlock or a key icon in the grey bar at the bottom of your screen.

Being in 'secure mode' means that all of your details are encrypted to help keep them secure. Encryption creates billions of code combinations to protect each transaction made on our site, so your card details cannot be viewed by anyone else using the Internet.

We recommend that you always close down your Internet browser when you have finished shopping online, especially if you use a shared PC. This will delete temporary Internet cookies from any sites that you may have visited.

Transaction Security

The transfer of the less sensitive transaction details is encrypted and digitally-signed. This ensures that the information passed is secure and tamper-proof.

Security for the Shopper

Any communication between the customer and the payment gateway is encrypted to the maximum strength supported by the customer's browser. The customer is also protected from fraudulent use of their card in a "card not present" environment, by their card issuer.

Data Storage

All data stored on our systems is held on encrypted and highly secured databases. Protx are regularly audited by Visa and MasterCard to ensure that their systems conform to the latest security standards.

Miscellaneous

  1. We recommend orders are placed at least 5 working days before delivery
  2. The courier will return parcels not delivered after five days. Please note that there is a surcharge for deliveries to the Scottish highlands.
  3. Any parcels requiring to be re-sent will incur a charge of £15.00.
  4. We reserve the right to substitute with goods of an equal or higher value. Items shown in photographs may differ from description of contents.
  5. VAT and duty are included in all prices shown at the current, standard rate where applicable. Some gifts contain zero rated food items, on these items a percentage VAT rate has been calculated.
  6. Consequential loss. This is limited to the purchase price of the gift.
  7. Alcohol. Gifts containing alcoholic drinks cannot be sold to persons under 18 years of age. By placing an order it is taken that the buyer is confirming that they are over this age
  8. Force Majeure. Whilst every effort will be made to meet customers demands, cancellations or variations may be necessary as a result of an Act of God, War, Strike, Lockout, Labour Dispute, Fire, Flood, Drought or other causes beyond the control of Cornish Goodies Ltd.
  9. Reservation of title. All goods remain the property of Cornish Goodies ltd until they have been paid for in full.

The statutory rights of the consumer are not affected by any of the above.
